Filing an Appeal

Filing a Notice of Appeal

Notices of appeal should be filed by email at admin@erac.ohio.gov. Alternatively, you can mail your notice of appeal to 30 E. Broad St., 4th Floor, Columbus, OH 43215. Notices of appeal are NOT accepted through ERAC's E-Filing Portal!

If filing by email, please mail your $70 filing fee separately.

Contents of Notice of Appeal

A notice of appeal should include:

  • Contact information for the appellant(s) and appellee(s)
  • Assignments of error
  • Relief sought
  • A copy of the final action being appealed

Filing Fee

The filing fee is $70.00. A checks or money order should be made payable to Treasurer, State of Ohio. The Commission does not accept cash or credit card.

Filing Deadline

Appeals must be filed within 30 days of the action being appealed; or in some cases, within 30 days of notice of the action. For more information, please see R.C. 3745.04 and 3745.07.

What happens after I file my notice of appeal?

Generally, ERAC appeals proceed along one of two paths--(1) a joint status reporting track (if the parties are actively trying to negotiate a settlement) or (2) a case management track (if the case cannot be settled and the parties wish to proceed towards a hearing). 

Appeals placed on a case management track follow a procedure similar to common pleas court. The parties will have an opportunity to conduct discovery, file motions, and if necessary, proceed to a de novo hearing.

Does filing an appeal automatically stay the final action?

No. The filing of an appeal does not automatically suspend or stay execution of the action being appealed.  For information regarding the procedures for filing a motion for stay, see Ohio Adm.Code 3746-5-21 and 3746-5-22.
